This website is managed by Fujifilm Imaging Products & Solutions.
Fujifilm Imaging Products & Solutions is the data controller for the processing of your personal data within the meaning of the AVG.

2. What data do we collect?

Photographers.

When you register an account as a photographer or when you sign up for our newsletter, your data will be processed. This can be the following data:

  • Name, address, zip code and/or city;
  • Company name;
  • Country;
  • Bank account number;
  • VAT number;
  • Phone number;
  • E-mail address;
  • URL of your website.

We process your name and address data to send you information, to provide you with access to our services, including but not limited to access to your account, to the photos taken and to the ordering process.
This data is necessary for the execution of the agreement, without it we cannot include photos in the account and offer them to consumers.

Because we want to offer you the possibility to order the photos for a longer period of time, we save account data from pro accounts and the photo files for a period of up to 10 years. We keep the account data from free accounts for a period of up to 2 years.

We also process your name and other data necessary to ensure correct payment. We are legally obliged to do so. When paying, we will also see from which account this came and who the account holder is. We keep any quotes, invoices and payment information for 8 years.

In addition, we also receive personal data from you as a photographer that does not come directly from the data subject (the person to whom that data relates). These are:

  • Portrait photos;
  • Student lists, including the name, group and student number of the student.

With you, the photographer, we have entered into a processing agreement, in which we have made agreements on how we will handle this data on your behalf. To inform the data subject of how we handle this data, you, as the photographer, can offer this privacy statement.

 

Consumers

When you place an order with us as a consumer, or when you sign up for our newsletter, your data is processed. This may include the following data:

  • Name, address, zip code and/or city;
  • Country;
  • Bank account number;
  • IP-address.

We process your name and address data to send you information, to provide you with access to our services, including but not limited to access to your account, to the photos taken and to the ordering process. In addition, the data is used to make it possible to order products on our website.

Finally, the data are used to enable and validate the payment of ordered products, to deliver the ordered products and to be able to contact you, among other things, regarding an order.

This data is necessary for the execution of the agreement, without them we cannot deliver the ordered pictures. Because we want to offer you the possibility to order the photos for a longer period of time, we save your account information and the photo files for a period of up to 10 years.

Newsletter

We would like to send you a newsletter, because you are a customer of ours or because you signed up for it yourself. We therefore process your email address to be able to send you information and news. This is done on the basis of your consent. We offer you the opportunity to unsubscribe under each newsletter. We keep your data for this purpose until you unsubscribe.

3. With whom do we share your personal data?

Recipients of personal data

We share your data with the following third parties, including our processors:

  • Storage of (portrait photos) on external servers.
  • CRM system.
  • External mailing program for storing mailing lists and sending newsletters.
  • The photographer has the option of viewing a magazine online. For this purpose they provide name/email/phone number. This data is stored by us.
  • The website where our domain names are registered..
  • Parties that process photo files into a product and send it out.
  • A party that creates login cards, containing a picture of the child, name, school name, group and the code with the password. These cards are sent directly to the photographer or the address the photographer enters.
  • Payment services that take care of the payments in the web store (Netherlands and Belgium).
  • External server manager for our servers. These machines are located in the data center in the Netherlands.
  • If you order a photo file from us, the photographer may request your account information (customer information) from us. In that case your data will be shared with the photographer.

 

Transfer to a third country

We try to process personal data as much as possible within the EEA, but sometimes we cannot avoid using services from outside the EEA. These companies are based in an appropriate country designated by the European Commission.

The servers of our email program for sending newsletters are located in the United States. Your data may therefore be transferred, stored and processed in the United States. The transfer of this data is done under the EU-US Privacy Shield Framework.

If the recipients of the data are not located in an adequate country, appropriate safeguards have been put in place or binding corporate rules have been established. In most cases, we have used the EU Model Clauses. You can request a copy of these by sending us an email.

We are happy to inform you about the rights you have and the influence you can have on the processing of your personal data.

These measures, including encryption of your personal data, ensure a level of security appropriate to the data we process. For example, we have also provided strong passwords, firewall protection and virus scanners. Our employees are also trained to handle your data in a privacy-friendly manner.
